Welcome to Publifai (publif.ai), a product operated by PublifyX Tech Pvt. Ltd., a company incorporated in India ("Company", "we", "us", "our").

By accessing or using our website and services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

2. Definitions

• "Service" refers to the Publifai platform, including website creation, management, and related services accessible via WhatsApp, Telegram, or our website.
• "User" / "You" refers to any individual or business entity that accesses or uses the Service.
• "Website" refers to publif.ai and any subdomains operated by us.
• "Content" refers to text, images, logos, business information, and other materials provided by the User or generated through the Service.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use our Service. By using our Service, you represent and warrant that you meet these requirements.

4. Services Offered

Publifai provides the following services:

• AI-powered website creation and management via WhatsApp/Telegram chat
• Website hosting on custom domains or subdomains
• SEO optimization and Google/AI search visibility
• Ongoing website updates and maintenance
• Business listing and digital presence management

The specific features available to you depend on your chosen subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

5. User Accounts and Responsibilities

By using our Service, you agree to:

• Provide accurate, current, and complete information about yourself and your business
• Not use the Service for any unlawful, fraudulent, or harmful purpose
• Not upload or transmit content that is defamatory, obscene, infringing, or otherwise objectionable
• Not attempt to gain unauthorised access to any part of the Service or its infrastructure
• Be responsible for all activity that occurs through your WhatsApp/Telegram number linked to the Service

6. Payments and Billing

All payments are processed securely through Razorpay, our authorised payment gateway. We accept UPI, credit/debit cards, net banking, and other payment methods supported by Razorpay.

• Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Subscription fees are billed on a recurring monthly or annual basis as per your chosen plan.
• One-time setup fees, where applicable, are non-recurring and charged at the time of onboarding.
• We reserve the right to revise pricing with 30 days' prior notice. Existing subscriptions will be honoured at the agreed rate until renewal.

7. Intellectual Property

• Your Content: You retain ownership of all business information, logos, images, and text you provide to us. By submitting Content, you grant us a limited licence to use it solely for the purpose of providing the Service.
• Our Platform: The Publifai platform, including its design, code, AI models, and branding, is the intellectual property of PublifyX Tech Pvt. Ltd. You may not copy, modify, or distribute any part of our platform without written consent.
• Generated Websites: Websites created through the Service are owned by you, the User. However, the underlying templates and technology remain our property.

8. Website Hosting and Domain

• Free-tier websites are hosted on a Publifai subdomain. Paid plans may include custom domain support.
• If you bring your own domain, you are responsible for domain registration, renewal, and DNS management.
• We are not liable for any domain-related disputes, expirations, or transfer issues.
• Upon cancellation of your subscription, hosted websites on our subdomain may be taken offline after a 30-day grace period.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
• PublifyX Tech Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you to us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless PublifyX Tech Pvt. Ltd., its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

• You may cancel your subscription at any time by contacting us via WhatsApp or email.
• We may suspend or terminate your access to the Service if you breach these Terms or engage in fraudulent or illegal activity.
• Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

14. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you via WhatsApp or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
